What Is Consular Processing?

Consular processing is a requirement for individuals immigrating to the United States from another country. As part of this process, the individual must go through a U.S. embassy or consulate to apply for a green card. To obtain a family-based green card through consular processing, the petitioner of the person seeking a green card must be a U.S. citizen or have a green card.

The following immediate relatives are eligible for consular processing:

  • Spouse of a U.S. citizen
  • Unmarried child (under 21 years of age) of a U.S. citizen
  • Orphan adopted abroad by a U.S. citizen
  • Orphan to be adopted in the United States by a U.S. citizen
  • Parent of a U.S. citizen (who is at least 21 years old)

The following family members are eligible for consular processing:

  • Unmarried, adult sons and daughters (age 21 or over) of U.S. citizens
  • Spouses and unmarried children (under age 21) of permanent residents
  • Unmarried adult sons and daughters of permanent residents
  • Married sons and daughters (any age) of U.S. citizens
  • Brothers and sisters of adult U.S. citizens

Steps for Consular Processing

If you are eligible for consular processing and are ready to go through process, our attorneys can guide you through each step and help to ensure the process runs smoothly.

  • Verify your eligibility for a green card - Make sure that you qualify for a Green Card before applying, otherwise your application will be rejected.
  • File Your Petition - If you are applying through Family, you may use Form I-130 Petition for Alien Relative. Or if you are applying through an Employer, you can use Form I-140 Petition for Alien Worker. Ask an immigration attorney to help you find the right form for your situation.
  • Wait for USCIS decision - USCIS will notify you of their approval or give reasons for a denial. If approved, the petition will be sent to the National Visa Center.
  • Notification from National Visa Center - Once the National Visa Center receives the petition, they will notify you and provide you with an immigrant visa number, as well as information about the processing fees or additional documentation they may need.
  • Interview - You will then need to schedule an interview at the consular office. After your interview, your case will be processed and a decision will be made on whether to grant you a green card.
  • Arrival in U.S. - If your visa has been granted, you be given a visa packet, which you can use to travel to the U.S. Once in the U.S., you will enjoy a permanent resident status.
  • Receive Green Card by Mail - You will receive your green card by mail after your arrival in the US.
